Joseph Carroll Sentenced to 197 Years to Life Plus 10 Years 4 Months in Prison for Murders and Shootings from 15 Years Ago Starting in 2009

OAKLAND, CA — District Attorney Pamela Price announced that Joseph Carroll (38) was sentenced to 10 years and four months plus 197 years to life in state prison for the deaths of Nguyen Ngo, Nehemiah Lewis, Andrew Henderson Jr., and the attempted murders of Deandre Ware and Bao Ngo following a jury verdict.

On August 22, 2024, the jury issued its guilty verdicts on ten counts: two counts of first-degree murder, one count of second-degree murder, two counts of attempted murder, three counts of possession of a firearm by a felon, one count of assault with a firearm, and one count of shooting at an occupied vehicle. The guilty verdicts include six gun enhancements which allowed the Court to impose significantly longer sentences. The jury found the defendant not guilty of count 11, the attempted murder of Aaron Shaw.

The testimony and evidence presented at trial showed that on April 23, 2009, Mr. Carroll murdered Nguyen Ngo during a drive-by shooting in the City of Oakland. In that incident, Mr. Carroll also attempted to murder Nguyen’s brother, Bao Ngo, who was injured in the shooting.

The testimony and evidence also showed that on May 3, 2010, Mr. Carroll attempted to murder Deandre Ware. The jury heard evidence that Mr. Carroll had threatened to kill Mr. Ware and Nehemiah Lewis as part of a gang rivalry and dispute. Further testimony and evidence showed that Mr. Carroll shot and killed Mr. Lewis as he was exiting his car in Oakland on June 11, 2010.

The jury also heard testimony that on April 13, 2011, Mr. Carroll murdered Andrew Henderson Jr. during another drive-by shooting in Oakland.

Despite the age and complexity of the case and the long delay in prosecution of Mr. Carroll for crimes he committed as long ago as 15 years, the trial team was able to prove his guilt of multiple deadly crimes beyond a reasonable doubt. The trial lasted several months and required a sustained effort by the District Attorney’s Office to bring the case to a successful conclusion.

“This was a very challenging case, and we appreciate the time the jury took to listen to the evidence and render a fair decision. I also commend the trial team that dedicated months of hard work and sacrifice to fight for justice and hold Mr. Carroll accountable for his outrageous behavior.” said DA Pamela Price. “This case exposed a level and scope of violence that was outrageous and totally unacceptable in our County. Unfortunately, no amount of time will heal the hurt inflicted on the families of the victims. The sentence does, however, reflect a need to protect public safety from this type of violence.”
