Oakland – Today, District Attorney Ursula Jones Dickson announced a $16 million settlement with Walmart, Inc. A law enforcement investigation found that Walmart illegally sold expired infant formula and over-the-counter (OTC) drugs.
Under California law and the terms of the judgment, Walmart is prohibited from selling expired infant formula and OTC drugs in California. In addition, Walmart agrees to implement an Enhanced Expired Product & Inventory Compliance Program, which includes employee training and hours dedicated to ensure that OTC drugs and infant formula are safe. The Alameda County District Attorney’s Office will receive $2.2 million in civil penalties and $60,000 in cost recovery.
The investigation revealed no evidence that the sale of outdated or expired products resulted in physical harm to consumers. In addition, Walmart cooperated with law enforcement upon learning of the investigation and took proactive measures to work towards compliance with the law before any settlement was reached.
The Alameda County District Attorney’s Office urges all retailers who sell OTC drugs or infant formula to review their inventory practices to ensure full compliance with state and federal law.
