Misch Faces 50 Years to Live in Prison

Oakland, CA – Today, Chief Assistant District Attorney Royl Roberts announced that a jury found David Misch (63) guilty of one count of first-degree murder for killing Jennifer Duey and one count of first-degree murder for killing Michelle Xavier. The naked bodies of both women were found in a remote area in the City of Fremont on February 2, 1986.
The evidence presented at the trial showed that DNA found under Jennifer Duey’s nails in 2001 belonged to Mr. Misch. In 2003, while serving a life sentence for a murder he committed in December of 1989, Mr. Misch claimed to Fremont Police that he had seen the two young women being kidnapped at gunpoint and tried to save them. This was his explanation for the presence of his DNA in this case. Also presented as evidence was a partial license plate number written on one of the victim’s hands associated with Mr. Misch and his prior convictions.
Chief Assistant District Attorney Royl Roberts had this to say following the verdict, “Mr. Misch was charged by this office 32 years after murdering Jennifer Duey and Michelle Xavier. He was found guilty by a jury four years later. This conviction is a testament to this office’s commitment to seeking justice for victims and their families, even if it takes decades. I only wish we could have delivered justice sooner for these two families. I thank the jury for their deliberation in this case. I want to commend Deputy DA Allyson Donovan and annuitant Deputy DA Mark Melton, who worked for several months to prosecute this case and conclude it successfully. I also want to recognize Inspector Steve Riley and Victim-Witness Advocate Lindsey Reynolds for their hard work and support throughout this case and the trial.”
David Misch faces 50 years to life after being convicted for these two murders. He is scheduled to be sentenced on January 21, 2025, at 10 am in Department 713 at the East County Hall of Justice.
